Global Chemical Regulation Updates: Latest Changes to US TSCA, EU Controls, and REACH

The US Environmental Protection Agency (EPA) postpones the effective date of the TSCA rule for trichloroethylene (TCE)

On January 28, 2025, the US Environmental Protection Agency (EPA) announced that it would postpone the effective date of the final rule for trichloroethylene (TCE) under the Toxic Substances Control Act (TSCA) from January 16, 2025, to March 21, 2025. This decision was made in accordance with an executive order issued by US President Trump requiring a review of regulations enacted in the final months of the previous administration. The EPA will use this period to reassess the factual, legal, and policy issues potentially addressed by the rule.

The European Commission strengthens enforcement to ensure the completeness and timely transposition of EU directives
The European Commission (EC) recently took action against member states that failed to promptly transpose EU directives into their domestic legislation. Because some member states have not yet notified their transposition measures, the EC has sent formal notification letters covering 11 EU directives in areas such as the environment, finance, justice, taxation, and transport. Currently, 27 member states have not yet completed transposition. These members must respond and implement the relevant regulations within two months, or they will face further EC enforcement action.

Regarding the control of banned and restricted substances in electrical and electronic equipment: The EC called on member states to fully transpose the directive on the restriction of hazardous substances in electrical and electronic equipment. The EC decided to initiate infringement proceedings and sent a formal notice to Cyprus for its failure to transpose Delegated Directive (EU) 2024/1416, the revised version of the Directive on the Restriction of Hazardous Substances in Electrical and Electronic Equipment (RoHS Directive 2011/65/EU), into its national legislation.

Formaldehyde withdrawal from the REACH SVHC proposal list
In February 2025, the European Chemicals Agency (ECHA) announced the official removal of formaldehyde from its recommended list of substances considered as SVHCs. Three substances remain on the recommended list for the first half of 2025. Companies should closely monitor subsequent changes to ensure compliance with the latest chemical regulations.
