EU announces revised version of RoHS directive

No. 13/ 2011

The revised RoHS Directive (2011/65/EU) was published in the Official Journal of the European Union on 1 July 2011 and entered into force on 21 July 2011. The new directive retains key elements of the existing directive, such as restrictions on the use of hazardous substances (without adding or removing any substances) and the possibility of granting exemptions for certain applications of these hazardous substances.

The main changes are as follows:

The scope covers all electrical and electronic equipment (EEE) except for certain specially exempted products, including medical devices (Class 8) and monitoring equipment (Class 9) exempted under 2002/95/EC, as well as newly added products in Class 11 (i.e., other electrical and electronic products not included in Class 10). Class 10 products, such as solar panels, large stationary industrial equipment, and military supplies, are exempted.
This allows manufacturers of newly included RoHS 2.0 products sufficient time to comply with the directive, and sets out a transition period for the relevant products.
Medical devices and monitoring and control instruments will be included in RoHS in stages:

Medical devices and monitoring and control instruments – July 22, 2014
In Vitro Diagnostic Medical Devices – July 22, 2016
Industrial Monitoring and Control Instruments – July 22, 2017
Although no new restricted substances were added, a mechanism for reviewing and supplementing the list of restricted substances was proposed, and four substances—DEHP, DBP, BBP, and HBCDD—will be given priority for evaluation after three years to consider whether to include them in the list of restricted substances.
RoHS compliance for electronic and electrical products has been incorporated into the requirements for CE marking, and specific provisions have been made for declarations of conformity, technical documents, etc.
The existing exclusion clauses were adopted and 20 new exclusions were proposed for medical devices and monitoring equipment, while different maximum validity periods for exclusions were specified for different product categories.

EU member states must transpose this directive into national law by January 2, 2013. Until then, the existing RoHS Directive 2002/95/EC will continue to apply.
