The EU submitted a revised notification No. 07/2011 to the RoHS Directive to the WTO.

  • 2011-09-01

The EU has submitted a notification to the WTO regarding amendments to the RoHS Directive.

No. 07/ 2011

The World Trade Organization Technical Barriers to Trade (WTO/TBT) Committee published document G/TBT/N/EEC/247/Add.1 on 21 March 2011. This notification is the EU informing the members of the TBT Committee that the European Parliament has approved the first reading position of the European Parliament and the Council on the proposed Directive on the restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS Amendment) dated 24 November 2010.

The proposal retains key elements of the existing directive, such as restrictions on the use of hazardous substances (without adding or removing any substances), and the possibility of exemptions for certain applications of these hazardous substances. The main changes are as follows:

  • Clarify the scope and definitions, and in particular, establish an annex that defines the scope of the RoHS Directive;
  • The validity period of the exclusion clause has been changed from 4 years to 5 years (7 years for medical devices and monitoring instruments).
  • Medical devices and monitoring instruments will be gradually included in the RoHS directive.
  • The newly revised RoHS Directive requires manufacturers to assume greater producer responsibility. Electrical and electronic equipment must bear the CE marking and the required technical documentation.
  • Establish a clear verification mechanism and adopt a more transparent and effective mechanism for "reviewing or revising the list of prohibited substances" so that future bans on substances can be based on scientific evidence and specific standards.

The revised RoHS Directive will enter into force 20 days after its publication in the Official Journal of the European Union. Within 18 months of its entry into force, EU member states must transpose the directive into national law. Prior to this transposition, the existing RoHS Directive 2002/95/EC will continue to apply.
