The United States requires prior notification for the importation of certain categories of products containing mercury.

On August 6, 2010, the U.S. Environmental Protection Agency (EPA) issued a final rule for a significant new use of mercury under the Toxic Substances Control Act (TSCA) in flow meters, pressure gauges, and natural gas temperature measuring instruments, which will take effect on August 20, except for products still in use since September 11, 2009.

As required, importers, manufacturers, or processors of mercury must notify the Environmental Protection Administration (EPA) at least 90 days in advance before commencing any designated activities. The EPA can then assess the purpose of the notification and, if necessary, prohibit or restrict the activities before they occur.

This move is part of the Environmental Protection Agency's further control of hazardous substances, and in some cases, it prohibits the use of harmful substances such as mercury and lead contained in certain products. Many U.S. states have already banned the sale of products containing mercury, including flow meters, pressure gauges, and thermometers, including California, Maine, Massachusetts, New York, and Vermont.
