On December 18, 2008, the European Parliament in Strasbourg, France, adopted a new Toy Safety Directive, covering issues such as the materials used in the production of children's toys, testing, and market regulation. The existing Toy Safety Directive 88/378/EEC had been in effect for 20 years, while the new directive primarily aims to raise safety standards to ensure that dangerous toys do not enter the market and to protect children from harm caused by dangerous toys. The new directive provides a more detailed definition and division of responsibilities for economic operators.

Manufacturers (product records must be kept for 10 years; toys must have type/serial numbers)

A new requirement has been added that manufacturers must provide an EC Declaration of Conformity. Manufacturers must retain this declaration for 10 years after the toy is placed on the market. Manufacturers must conduct safety/risk assessments and identify potentially hazardous substances in the toy; this record must be kept in their technical documentation.

chemical substances

Toys are prohibited from containing substances that may cause cancer, mutations, or are harmful to reproduction (CMR).
Fifty-five fragrances that cause allergies have been banned.
In addition to the eight substances currently restricted by the directive (antimony, arsenic, barium, cadmium, chromium, lead, mercury, and selenium), several new elements and their limits have been added.

other

Toys must not be attached to food; toys sold with food must be packaged separately.
Regulations will be established for toys with sound-producing functions.
The Executive Committee will commission CEN to set requirements for children's books made of cardboard/paper.

Warning signs

Strengthen the promotion of the use of warning labels: Correct, clearly visible, and easy-to-read warning labels should be visible at the time of sale, and websites selling toys should also comply with this regulation.
The warning sign “Not suitable for children under 3 years old” is easily misused, so this sign will also be prohibited.

Effective Date
The new toy safety directive is expected to be published in the Official Journal of the European Union in early 2009 and will come into effect 20 days after its official announcement. EU member states will be required to implement it within the following 18 months. Due to the requirements for testing and technological updates to children's toys, the new regulations provide a two-year transition period for manufacturers of children's toys.

SGS is a third-party testing organization recognized and approved by the U.S. Consumer Product Safety Commission, providing a wide range of services including toy testing and consulting. For more information, please feel free to contact our customer service staff by letter or phone.
