Canadian Consumer Product Safety Act

  • 2011-10-26

Challenges

The new Consumer Product Safety Act of Canada (CCPSA) enacted by Health Canada came into effect on June 20, 2011. This act updates the Hazardous Products Act (HPA), which is no longer adequate for current needs, and aims to protect consumer health and safety by preventing potential or actual harm from consumer products. The CCPSA's requirements for Canadian manufacturers, importers, distributors, and retailers include:

  •    Product Testing and Documentation – Governments may require products to undergo testing to verify their safety and regulatory compliance. Testing can be conducted by the responsible party, a third-party laboratory, or the government, and proof of testing should be available when necessary.

  •    Record keeping – Relevant records should be kept for six years, including the manufacturer's name and address, as well as product sales locations, batch codes, and other information, for future tracking and retrieval;

  •    Mandatory Notification – Within two calendar days of a reportable health/safety incident or recall, the manufacturer, importer, or seller must notify Health Canada and the company that sold the product to them, and submit an incident report to Health Canada within 10 days.
