Dimethyl fumarate (DMF) was added to the list of restricted substances in Appendix 17 of the REACH regulation

  • 2012-12-25

On May 15, 2012, the Official Journal of the European Union published Regulation (EU) No 412/2012, formally adding dimethyl fumarate (DMF) to item 61 of the list of substances in Annex 17 of the REACH Regulation (regarding the manufacture and marketation of hazardous substances, mixtures and finished products). This regulation came into effect 20 days after its publication in the Official Journal of the European Union and required member states to unconditionally transpose it into their national laws.

Prior to this, on January 26, 2012, the EU issued amended Regulation 2012/48/EU, extending the effective date of the dimethyl fumarate (DMF) ban (2009/251/EC) to March 15, 2013. However, Regulation 2012/48/EU explicitly states that if the proposal to include dimethyl fumarate in Annex 17 of the REACH Regulation for mandatory control is formally adopted before the former, the dimethyl fumarate ban will take effect immediately. In other words, the EU's previous Directive 2012/48/EU, which extended the effective date of dimethyl fumarate, will be simultaneously repealed on the effective date of (EU) No 412/2012, meaning that from June 4th, the use of dimethyl fumarate will be restricted throughout the EU.

Note:

Dimethyl fumarate (DMF) is a volatile compound commonly used as a fungicide and also in desiccant bags to prevent mold growth on leather, furniture, shoes, or leather accessories during storage or transport. Contact with or inhalation of DMF can cause irritation and harm to the skin, eyes, and upper respiratory tract.
