May 5, 2014

On March 7, 2014, the California Office of Environmental Health Hazard Assessment (OEHHA) released a proposal to amend the existing warning labeling requirements of Proposition 65. A workshop was held from April 14, 2014, encouraging all interested parties to submit comments. The deadline for comments on the draft proposal was extended to June 13, and OEHHA staff continued to meet with stakeholders during this period. This proposal was to be formally submitted in the summer of 2014, and if adopted, it would take effect in 2015. According to this proposal,

  • Consumer products should be labeled with the GHS (Globally Harmonized System) "health hazard" symbol as required.
  • Consumer products should include the names of well-known chemical substances; 12 categories of chemical substances have been identified that require special warning labels.
    • 丙烯醯胺(Acrylamide)
    • 砷(Arsenic)
    • 苯(Benzene)
    • 鎘(Cadmium)
    • 磷酸三(二氯丙基)脂(Chlorinated tris【tris(1,3-dichloro-2-propyl)phosphate(TDCPP)】)
    • 二惡烷(1,4-Dioxane)
    • 甲醛(Formaldehyde)
    • 鉛(Lead)
    • 汞(Mercury)
    • 鄰苯二甲酸鹽(Phthalates)
    • 煙草煙霧(Tobacco smoke)
    • 甲苯 (Toluene)
  • Warning labels should include warnings such as "carcinogen," "reproductive toxicity or carcinogenicity," or "reproductive toxicity."
  • The website address of OEHHA must be provided so that the public can access detailed information about the warning.
  • Small businesses are required to address their minor violations within 14 days.
